1. PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
On the one hand, the provider of products and services, Ana Isabel Teixeira Pimenta (hereinafter also referred to as “the provider”), with registered office at Carrer de Castanys 10, 08005 Barcelona, with Tax ID Y0368084Y, customer service telephone: 602012864 and e-mail info@enfermeracreativa.com , being the owner of the website www.enfermeracreativa.com , sets out the contractual document governing the purchase of products through the aforementioned website.
On the other hand, the user/client (hereinafter “the user” or “the client”), registered on the website with a username and password for which they are fully responsible, and responsible for the accuracy of the personal data provided to the provider.
BOTH PARTIES ACCEPT this document, which implies that the user:
- Has read and understands the contents herein.
- Is of legal age and has the capacity to contract.
- Assumes all obligations set forth in this document.
- Has read and accepts these general purchasing conditions from the moment they acquire any product offered.
This document may be printed and stored by users.
It is recommended to keep a copy of the data contained in the purchased products.
The provider makes the email address info@enfermeracreativa.com available to users to raise any questions regarding these conditions.
These terms shall remain valid indefinitely and will apply to all contracts made through the provider’s website.
The provider reserves the right to unilaterally modify these General Conditions without affecting the goods or promotions purchased prior to such modification, in order to improve the products offered. In any case, these general conditions must be consulted before purchasing products.
The provider is not responsible for data or file loss, nor for damages resulting from a possible failure in the user’s backup.
The provider is not responsible for consequences resulting from improper use of the products sold on the website.
The provider’s civil liability for the products and services supplied is limited to their purchase price. The user waives any claims against the provider, under any circumstances, in case of dissatisfaction with the products purchased from www.enfermeracreativa.com or in case of possible failures, delays, or errors in website access, or loss of data or other information on the user’s computer or network accessing the website.
The provider sells online courses and social media management products via the website and does not operate a physical store.
2. OBJECT OF THE CONTRACT
2.1 Scope of Application: This contract regulates the purchase and sale relationship between the provider and the user when the latter accepts these purchase conditions during the online contracting process by checking the corresponding box. These General Terms and Conditions of Contracting (GTCC) shall apply from the day the order is placed.
The contractual purchase relationship involves the delivery, in exchange for a specific amount publicly displayed on the website, of a specific product.
2.2 Territory of Application: The provider’s online store is active worldwide.
2.3 Capacity to Contract: To place an order, the user must be of legal age and have the capacity to contract.
2.4 Customer Acceptance: Validation of an order through the website www.enfermeracreativa.com is carried out by email and also implies automatic acceptance of the General Terms and Conditions (GTC). These conditions are available on the aforementioned website or, if the user so wishes and requests, they may be provided by email.
2.5 Modification of the GTCC: . Modification of the GTCC: The provider reserves the right to make changes or modifications to these GTCC; users are advised to review them regularly. If changes are introduced after an order is placed, the conditions in force at the time of that order will apply.

3.1 Price Publication: Prices displayed may exceptionally contain errors and be lower than the actual price. If this occurs and the user’s order has been confirmed, the provider will contact the user immediately to issue a new confirmation with the correct price. If the correct price is higher, the user may cancel the order and be refunded any amount already paid.
3.2 Product Information: Information in advertisements, brochures, written material, the website, and by provider agents or employees constitutes an invitation to purchase and does not constitute an offer.
The contents of www.enfermeracreativa.com are continuously updated and revised in order to provide customers with the most complete and detailed information possible. Therefore, in exceptional cases, certain content may temporarily display provisional information about some products. Should the information provided not correspond to the characteristics of the product, the customer shall be entitled to withdraw from the purchase at no cost.
All contractual information on the website is provided in Spanish. Communication and contracting will be in Spanish unless the client requests another language prior to starting the process.
3.3 Availability: Occasionally, not all products/services may be available due to stock or capacity limits. In such cases, the provider will contact the client to choose between:
- An alternative product with similar characteristics.
- Notification of product availability if the client prefers to wait.
If suggestions are declined, the order will be canceled and any payments refunded.

Likewise, orders received over the weekend will be processed first thing Monday morning or the next business day.
3.6 Fraud: If fraud or anomalies are detected, the provider may cancel the transaction for security reasons.
4. PURCHASE PROCEDURE
To access the products offered by the provider, the user must register through the website by creating a user account. To do so, the user must freely and voluntarily provide the required personal data, which will be processed in accordance with current data protection regulations.

- Click “Checkout” to place the order. Confirmation with order summary, customer info, and payment method will appear.

In any case, the provider's contracting platform will inform the user, once the contracting procedure is completed, via email, of all the characteristics, price, transport methods, contracting date and estimated delivery of the purchased product.

5. SHIPPING / DELIVERY
Physical products: Deliveries only within mainland Spain and Balearic Islands.
5.1 Delivery Address: Users provide the delivery address.
Provider is not responsible for errors in delivery due to inaccurate information or causes beyond the courier.
5.2 Shipping Confirmation: Upon dispatch, the user receives an email with tracking number.
Delivery is considered complete when the courier delivers to the user or authorized person.
5.3 Damages: The products are delivered in secure packaging. If, upon delivery, it is clearly and visibly apparent, without needing to open the shipping or product packaging, that a product has defects caused by transport damage, or if there is an error in the merchandise received, the customer must note this on the delivery receipt provided by the carrier and immediately contact Customer Service. 602012864 or by email info@enfermeracreativa.com, within 24 hours of receipt, in order to request the return of the affected product(s) and proceed with their replacement by others in optimal condition, or request a refund of the price paid for them, as indicated in said email.
It is the user's responsibility to check the products at the time of receipt and to state any exceptions and claims that may be justified in the delivery receipt document.
A delivery note with no record of damage shall be deemed to confirm that the product was delivered with the packaging in perfect condition. Likewise, if any damage to the product is detected once the package has been opened, while the packaging is in perfect condition, the customer has 24 hours from receipt to contact the provider via the Customer Support line 602012864 or by email at info@enfermeracreativa.com. After 24 hours from delivery, no claims for product damage will be accepted.

In case of any issues with the download, they will be handled by customer service or technical support.
6. PRICES AND VALIDITY OF OFFERS
The prices of the products/services offered on www.enfermeracreativa.com are those indicated on that website. These are expressed in euros (€) and include the applicable VAT (Value Added Tax) in Spain.
However, in accordance with Law 37/1992, of December 28, on Value Added Tax, the transaction may be exempt or not subject to this tax depending on the buyer's country of residence and the capacity in which they act (business/professional or private individual). Consequently, in some cases, the final order price may differ from the one displayed on the website.
The payment made to the provider will result in the issuance of an invoice in the name of the registered user.
For the issuance of the corresponding invoices, the customer must send their tax information to the contact email info@enfermeracreativa.com . In this way, the invoice will be automatically sent to the provided email address.
Promotions apply if orders are placed during the promotion period. Payment records serve as proof of transaction date.
The data recorded by the different payment methods constitutes proof of the date on which the financial transactions were carried out and will serve to determine whether or not said order is subject to promotion.

7. PAYMENT METHODS
The available payment methods are detailed below:
7.1 Credit/Debit Card: The user must have a valid credit or debit card and must enter all digits of the card number on the corresponding form. The transaction will be processed at the time of ordering. Only Visa and MasterCard cards are accepted.
Only secure card payments will be accepted where the cardholder's identity is authenticated according to the method established by their bank, through secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode").
The order will not be considered or processed until payment has been authorized by the user’s bank or financial institution.
The system used is called SSL (Secure Sockets Layer), a payment system in a secure environment, as it allows the encryption of information transmitted during the transaction, ensuring its confidentiality.
7.2 Bank Transfer: Instructions provided at checkout. Must include order number and name; payment within 7 days, otherwise order canceled.
7.3 PayPal / Other Platforms: Once the purchase is complete, if this payment method is chosen, the user will be redirected to the official PayPal website, where they can make the payment. Once the payment is successfully processed, the order will be finalized and an email with a summary of the purchase will be sent. By clicking “Return to website,” the user will be taken back to the website to view and print the order. PayPal has its own Privacy Policies and the provider has no responsibility for them.
8. RIGHT OF WITHDRAWAL
Cancellation of a physical product order
An order can only be cancelled if it has not yet been shipped. To cancel an order, an email must be sent to info@enfermeracreativa.com providing the order number you wish to cancel.
The refund will be made by bank transfer.
Return of physical product in perfect condition:
The user has 14 calendar days from the date of receipt of the product to request a return (Art. 71 of Law 3/2014, of March 27). If you are not satisfied with the product or any of the products in your order, you may exercise your right of withdrawal by completing the form attached to these terms and conditions, including your order number and contact information, to obtain a refund for the product(s) within a maximum period of fourteen (14) calendar days following receipt of the order. Unless the return is due to product defects, the customer will be responsible for the shipping costs. The product must be returned in its original packaging and in perfect condition.
The user will be provided with a return number and instructions for the return procedure. This must be sent to the provider via email info@enfermeracreativa.com or by postal mail, always within 14 calendar days of receiving the order. After this period, the return or exchange of the product(s) can only be requested for technical reasons covered by the warranty of the respective product(s).
You must return the product with all the elements with which it was delivered, without damage or signs of wear of any kind, and without signs of improper use or use different from its own nature, to the address provided.
The product must be returned in its original packaging. If this is not possible, the product will be subject to a depreciation in value. The customer is responsible for the packaging and protection of the product(s) being returned, as well as all shipping costs.
Provided the products are returned within 14 calendar days, undamaged and without any signs of wear, and in compliance with the requirements set out in this section, along with the return number that will have been provided, you will be refunded the full purchase price. The costs associated with this procedure will be borne by the user.
In any case, the product must include:
- The return number provided
- The order number
- Purchase date and withdrawal date
Non-applicable to:
- Products not in perfect condition.
- Opened software or digital downloads.
The right of withdrawal may not be applied in the following cases:
- If the product is not in perfect condition.
- If the product packaging is not the original or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition; the use of seals and adhesive tape applied directly to the product is prohibited.
- When the product is opened and it cannot be proven that it has not been used.
- For software applications downloaded directly through the portal.
Return of a defective physical product
If the product is defective upon arrival, the user must inform the provider of the non-conformity within two months of receipt. To do so, they must send an email to info@enfermeracreativa.com with the order number and an explanation of the reason for the return.
Customer Service will contact the customer via email or telephone, explaining how to proceed with sending the defective product and providing a return number.
The product(s) from the order must be returned to the address provided, with all the elements with which it was delivered and in perfect condition, without damage or marks that denote improper use or use different from its own nature.
Once the defective product is received in compliance with these requirements and it is verified that the product(s) have a manufacturing defect, the provider will contact the customer to arrange for repair, replacement, compensation, or contract termination. In any of the above cases, the provider will bear the costs associated with this process.
The right of withdrawal may not be applied in the following cases:
- If the product is not in perfect condition.
- If the product packaging is not the original or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition; the use of seals and adhesive tape applied directly to the product is prohibited.
- When the product is opened and it cannot be proven that it has not been used.
- For software applications downloaded directly through the portal.
Refunds and Returns for Infoproducts or Online Training Programs
In accordance with current regulations, the user shall have the right to withdraw from the contract for a maximum period of 14 calendar days without the need to state a reason and without incurring any costs, except for those provided for in Articles 107.2 and 108 of Royal Decree 1/2007, of November 16, which approves the revised text of the General Law for the Protection of Consumers and Users.
This right of withdrawal does not apply, among others, to contracts for the supply of audio or video recordings, discs, and computer software that have been unsealed by the consumer and user, as well as computer files supplied electronically, which can be downloaded or played immediately for permanent use.

9. ONLINE DISPUTE RESOLUTION PLATFORM
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access platform for online dispute resolution between the user and the service provider, without the need to go to court, through the intervention of a third party, called Dispute Resolution Body , which acts as an intermediary between both parties. 11. INTELLECTUAL PROPERTY
Through these General Terms and Conditions, no intellectual or industrial property rights over the website www.enfermeracreativa.com or any of its constituent elements, including course presentations and products/services offered on this website, are transferred. The user is expressly prohibited from reproducing, modifying, distributing, publicly communicating, making available to the public, extracting, using, or forwarding any of them by any means or procedure, except in cases where it is legally permitted or authorized by the holder of the corresponding rights.
The user acknowledges and accepts that the entire website—including, but not limited to, texts, articles, legal templates, images, designs, software, content (including its structure, selection, arrangement, and presentation), audiovisual materials, and graphics—is protected by trademarks, the provider's copyrights, and other legitimate registered rights, in accordance with international treaties to which Spain is a party and other proprietary rights and laws of Spain.
12. MODIFICATION OF TERMS
Provider may modify the website and these terms at any time. Users are advised to review conditions regularly. Invalid clauses do not affect the remainder.
13. APPLICABLE LAW AND JURISDICTION
Spanish law applies.
These Terms are subject to Spanish legislation including General Terms of Contracting, Consumer Protection, Electronic Commerce, and Information Society Services laws.
Electronic contracts with private users are deemed concluded at user’s residence. Contracts between professionals and users are deemed concluded at the provider’s location.
In case of dispute, parties submit to the courts of the user’s domicile, waiving any other jurisdiction.
